Oliech drags Kenyan giants Gor Mahia to Court over unpaid dues.

By Shafic Kiyaga

Former Kenya Harambee stars captain Dennis Oliech, has dragged former side Gor Mahia to court over what he claims to be unpaid dues and unlawful dismissal.

This is after the player was sacked by Gor Mahia amidst accusations of the player joining politics, avoiding communication with club officials, poor performance and failure to attend training sessions.

Oliech first made threats of dragging the club to court, giving Gor Mahia seven days to act on his grievances.

The club failed to work on his grievances, and now he has made good his threat by filling a law suit against the Kenyan champions.

“They didn’t give me time and never bothered to hear from me. The case will be handled by Sports Tribunal and I am sure I will get affair judgement. I wanted to take them to FIFA, but I have been advised the Tribunal handles cases faster,” said Oliech.

According to the Daily Nation Kenya, documents dated September 9 and addressed to Gor Mahia CEO Lordvick Aduda show that Oliech, through the Wambilianga Majani and Associates Advocates law firm has instructed the management of the 18-time Kenyan Premier League champions to pay the players dues accruing up to KSh6.24 million.

“Upon examination of your actions, we have found the same to be malicious and at variance with the express terms of the employment contract, FIFA Regulations on the Status and Transfer of Players, Employment Act 2007, Fair Administrative Action Act, 2015 as read with Article 47 of the constitution of Kenya,”

“We have instructions to demand Ksh6, 240,000. Take notice that unless our clients receive the aforementioned amount demanded, we have strict and irrevocable instruction to file suit against you,” Part of the suit reads.

Oliech’s contract still had 18-months to run, but was terminated by Gor Mahia last month, something the striker deemed to be unfair.

Thus, the striker is demanding the club pays him KSh1.4 million as balance of his signing fee, KSh2.2 million as loss of income and a further KSh2.6 million for the unlawful termination.

Gor Mahia Chief Executive Aduda, said that they are ready for Oliech and will act according to the law once they receive the suit because they believe it is the player who erred.

But at the moment, Aduda maintains that they are focused on the team’s CAF Champions league ties against USM Algiers this weekend.

“We will act legally once we receive his suit but as at now, we are not bothered and have closed that chapter. We are ready for him because we believe he is the one who erred,” said Aduda.
